Terms of Service

These Terms of Service govern all charter flights operated by National Air Charters LLC under FAA regulations and applicable U.S. law. Please read carefully before booking.
⚠️ Important: National Air Charters operates as a non-scheduled air carrier under 14 CFR Part 135 (Air Taxi and Commercial Operator Certificate). All flights are operated under a single-pilot certificate unless otherwise specified. Passengers acknowledge and accept the operational limitations of single-pilot charter operations.

1. Acceptance of Terms

By booking a charter flight with National Air Charters LLC ("Company," "Carrier," "we," "us"), you ("Passenger," "Client") agree to be bound by these Terms of Service, our Privacy Policy, and all applicable federal aviation regulations. If you do not agree to these terms, you may not use our services.

2. Carrier Information and Regulatory Status

National Air Charters LLC operates under authority granted by the Federal Aviation Administration (FAA) and is subject to:

Our Piper PA-31 Navajo aircraft is certified and operated under single-pilot authority as permitted by applicable FAA type certificate and 14 CFR Part 135. Passengers acknowledge that single-pilot operations are legal, FAA-approved, and subject to all applicable safety requirements. The Company maintains all required pilot certifications, medical certificates, and currency requirements.

2.3 Aircraft

Primary aircraft: Piper PA-31 Navajo (up to 5 passengers). The Company reserves the right to substitute an equivalent aircraft of equal or greater capacity when operationally necessary without penalty.

3. Booking and Payment

3.1 Reservation

All charter reservations are subject to aircraft availability and confirmation by the Company. A booking is not confirmed until the passenger receives written confirmation and required deposit payment is received.

Passengers must comply with all crew instructions, FAA regulations, and applicable law. The pilot-in-command has final authority over all aspects of flight safety under 14 CFR § 91.3. The Company reserves the right to refuse carriage to any passenger who:

Baggage is limited to approximately 40 lbs per passenger. Hazardous materials as defined by 49 CFR Parts 171–180 are strictly prohibited. The Company is not liable for loss or damage to passenger baggage beyond standard carrier liability limits.

7. Liability Limitations

7.1 Warsaw Convention / Montreal Convention

For international flights, passenger liability may be governed by the Montreal Convention (Convention for the Unification of Certain Rules for International Carriage by Air, 1999), which limits carrier liability in certain circumstances.

7.2 Limitation of Liability

To the maximum extent permitted by applicable law, the Company's liability for any claim arising from charter services shall not exceed the total amount paid for the specific charter flight giving rise to the claim. The Company is not liable for indirect, incidental, special, or consequential damages.

7.3 Force Majeure

The Company is not liable for delays, cancellations, or failure to perform due to weather, air traffic control restrictions, mechanical issues, government actions, natural disasters, or any other circumstance beyond the Company's reasonable control.

7.4 Insurance

National Air Charters maintains aviation liability insurance as required by applicable law and FAA regulations. Passengers are encouraged to obtain independent travel insurance.

8. International Operations — CBP and Customs

For all international charter flights, passengers must:

The Company submits passenger manifest information to U.S. Customs and Border Protection as required by law. Passengers who are denied entry by a foreign government or refused re-entry to the United States remain responsible for all associated costs.

9. Pets and Animals

Small domestic pets may be permitted in the cabin with prior written approval. All pets must comply with applicable USDA, CBP, and destination country requirements. Passengers are responsible for all required health certificates and import permits for international travel with pets.

10. Governing Law and Dispute Resolution

These Terms of Service shall be governed by the laws of the State of Florida and applicable federal law, without regard to conflict of law provisions. Any dispute arising from these terms shall be resolved through binding arbitration in Miami-Dade County, Florida, under the rules of the American Arbitration Association, except that either party may seek emergency injunctive relief from a court of competent jurisdiction.

11. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

12. Entire Agreement

These Terms of Service, together with our Privacy Policy and any booking confirmation, constitute the entire agreement between the parties regarding charter services and supersede all prior agreements.
